Belgium has the particularity ofbeing the only EU Member State to have introduced quotas to its legislation. The type of quota which has been implemented is prioritizing the number, without paying attention to how male and female candidates are positioned on the parties' lists. In the article the author examines the evolution of the number of wamen in Belgian Parliament across time. Comparisons are made within and between parties, before and after the law on quotas. The analysis shows that the (...) effect of quotas to a large degree is dependent on the will of parties to obtain more female representatives. Thus, if the major aim of a legislation on quotas is to impose a balanced gender structure in the representatives' assembly, the legislation ought to consider men's and women's positions on the lists. In recent years the concept of parity democracy has rapidly risen up the European political agenda. Using a threefold typology of sex-quotas, this article undertakes a classification of the measures taken by the 15 old E.U. member states to improve the gender balance in representative assemblies. This is then used as the basis for an exploration of the advantages and disadvantages of the parity approach as a tool to promote gender equality, including the constitutional obstacles which stand in its way. The article goes on to present a comparative study of several national systems in which attempts to achieve parity democracy have been pursued, concluding that, in order to maximise their effectiveness, parity measures must operate within a system of unbiased political structures and be properly adjusted to suit the particularities of individual national electoral regimes. We study 944 shareholder proposals submitted to 343 U.S. firms on climate change issues during 2009–2022. We use logistic and two-stage regression to estimate the propensity for a firm to be targeted or subjected to a vote at the annual general meeting and, for voted proposals, the determinants of that vote. We also examine whether climate-related proposals affect investor returns and how they relate to firms’ future environmental performance and greenhouse gas emissions. Compared to a matched sample, we first find (...) that activists target larger, more carbon-intensive, and less R&D-active firms. Second, voting likelihood is higher for firms with repeated and operations-related proposals and lower pre-proposal environmental ratings. By contrast, disclosure-related proposals are likelier to be negotiated and withdrawn. Third, repeated and operations-related proposals receive higher votes in favor, whereas votes on carbon-intensive firms do not. Fourth, building on the theory that investors act as if they distinguish among the different shareholder proposals based on the expected cost to the firm, we find evidence to support this idea. We find that investors respond negatively to ex-ante costlier proposals, such as those that relate to emissions reduction and target carbon-intensive firms. Fifth, targets’ future environmental performance rating is almost twenty percent higher after a proposal than before compared to the matched sample, whereas emissions do not budge appreciably. During the IAEA’s Mobile Radioisotope Exhibition (1960–1965) through the eventful roads of five Latin American countries (Mexico, Uruguay, Argentina, Brazil, and Bolivia), a variety of photographs were taken by an unknown Mexican official photographer, and by Josef Obermayer, a staff driver from Vienna. The exhibition carried not only bits of nuclear sciences and technologies, but also the political symbolism of the ‘friendly atom’ as a token of modernization. The photographs embarked on different trajectories, though all of them ended up at (...) the training and exchange official’s desk in charge of the exhibition, Argentinian physicist Arturo Cairo. The ones taken in Mexico also had a local circulation as propaganda intended to promote radioisotope applications. The two sets of images were intended to show the contrast between modernity and traditional society, but they did it from different gazes. Our paper argues that, in the case of Mexico, the photographer reinforced representations of the country which were already popularized by Hollywood for foreign and local audiences. On the other hand, the Viennese photographer’s gaze delivers an autoethnography of his dutiful journey. We also argue that Obermayer’s projection is one of what Roger Bartra has conceptualized as the ‘salvage on the mirror’. (shrink)

De manera inmediata y tradicional pensamos que hablar sobre política exige forzosamente ligarla a la idea de conflicto. Si bien es cierto que el carácter político marca ciertos modos de habitar el mundo, también es relevante aclarar que, a partir del concepto que tengamos de política, podremos darnos cuenta de si la idea de conflicto es inherente a esta o si la política puede ser pensada desde otro horizonte. Hans-Georg Gadamer nos ofrece una serie de reflexiones hermenéuticas en torno al (...) lenguaje y al diálogo; a partir de allí, intentamos atisbar un concepto de política no solo inherente al conflicto, sino también a su parte medular como lo es el diálogo prudente. Pensar en una política dentro del marco de un horizonte dialógico nos permite arrojar luz a problemas particulares que nos aquejan hoy, los cuales nos interpelan a pensar y repensarlos para comprender por qué hemos llegado a ser lo que somos. En la educación médica cubana se ha diseñado un currículo para el cumplimiento de su encargo social donde se inserta la enseñanza del inglés. Actualmente constituye una prioridad trabajar en la búsqueda de estrategias que favorezcan el perfeccionamiento idiomático de los egresados, en este sentido se desarrolló una investigación en la Filial de Ciencias Médicas de Colón con el objetivo de desarrollar la expresión oral en el inglés con fines específicos en el tercer año de la carrera de Medicina. Se (...) emplearon métodos como el análisis de documentos, la observación participante, y los registros anecdóticos. El sistema de actividades aplicado favorece la negociación de significados, toma de riesgos, mayor precisión al expresar ideas, así como el acercamiento del uso del idioma en situaciones reales con lo cual se logra mayor motivación, objetividad del aprendizaje e independencia, al emplear las habilidades lingüísticas para su desempeño profesional. In Cuban medical education, a curriculum in which English is integrated, is designed to fulfill a social mission. Presently, it is a priority to identify strategies that support the idiomatic improvement of graduates. To this end, an investigation was developed in the University of Medical Sciences of Matanzas at Colon Campus with the objective of developing speaking in English for Specific Purposes in the third-year of the medical program of study. Methods such as document analysis, participant observation, and review of anecdotal records were used. The resulting system of activities favors the negotiation of meaning, risk-taking, improved precision to express ideas and the expanded use of English language in real situations. This results in greater motivation, learning objectivity and independence to use language skills for their professional performance. (shrink)

Resumen El objetivo principal de este artículo es recrear la práctica de la hospitalidad en el contexto de la realidad migratoria actual, con la intención de aportar luz a la manera de gestionar la diversidad, de repensar la formación de identidad, de acercarnos a ciertas dinámicas políticas y últimamente de incentivar procesos de integración y cohesión social, especialmente en la vida de nuestros barrios. En nuestro mundo actual donde parecería ganar terreno la hostilidad sobre la hospitalidad, la práctica de la hospitalidad constituye un auténtico acto de resistencia.The main aim of this article is to recreate the practice of hospitality in the context of the current migratory reality, with the intention of bringing light to the way of managing diversity, of rethinking identity formation, of approaching certain political dynamics and lately to encourage processes of integration and social cohesion, especially in our vulnerable neighborhoods. For this purpose, the author delves into the biblical roots of hospitality, providing some clues to understand this virtue today. One of the sectors for which Artificial Intelligence applications have been considered as exceptionally promising is the healthcare sector. As a public-facing sector, the introduction of AI applications has been subject to extended news coverage. This article conducts a quantitative and qualitative data analysis of English news media articles covering AI systems that allow the automation of tasks that so far needed to be done by a medical expert such as a doctor or a nurse thereby redistributing their agency. We (...) investigated in this article one particular framing of AI systems and their agency: the framing that positions AI systems as replacing and outperforming the human medical expert, and in which AI systems are personified and/or addressed as a person. The analysis of our data set consisting of 365 articles written between the years 1980 and 2019 will show that there is a tendency to present AI systems as outperforming human expertise. These findings are important given the central role of news coverage in explaining AI and given the fact that the popular frame of ‘outperforming’ might place AI systems above critique and concern including the Hippocratic oath. Our data also showed that the addressing of an AI system as a person is a trend that has been advanced only recently and is a new development in the public discourse about AI. (shrink)

This book explores the future of critique in view of our planetary condition. How are we to intervene in contemporary constellations of finance capitalism, climate change and neoliberalism?

My goal in this paper is to compare Heidegger’s philosophy of science with Thomas Kuhn’s. With this comparison I want to pursue two goals: 1) using Kuhn’s arsenal of conceptual tools, to make Heidegger’s position appear in a clearer fashion; and 2) to show that Heidegger’s and Kuhn’s positions are not so different as one might expect. I will, thus, suggest that these philosophies can be compatible. I will show that, even if there are differences, there are many similarities as (...) well. I will address three issues: 1) the differences and similarities between Kuhn’s notion of paradigm and Heidegger’s notion of world; 2) the analogous concepts of “normal science” and “calculating thinking”; and 3) the source of intelligibility in both authors. Here, I believe, is where the main difference between both thinkers lays. (shrink)

RESUMEN En este trabajo me propongo demostrar que el concepto de dios en "El origen de la obra de arte" de Martin Heidegger no refiere a una figura divino-religiosa, sino que se debe enmarcar dentro del leitmotiv de toda su filosofía, la pregunta por el ser. La hipótesis a defender será la siguiente: Heidegger utiliza la noción de "dios" para describir el proceso de fundación de un espacio de sentido. En un primer momento analizaré algunos contraargumentos a esta hipótesis, según (...) los cuales Heidegger estaría hablando de la posibilidad de que el arte nos religue con los dioses como tales. Luego pasaré al argumento principal, en el que vincularé el ensayo sobre el arte fundamentalmente con el seminario sobre Parménides para mostrar cómo la noción de dios se conecta con el concepto de ser y de sentido. ABSTRACT In this essay I try to demonstrate that the concept of God in "The Origin of the Work of Art" by Martin Heidegger does not refer to a divine-religious figure but must be framed within the Leitmotiv of all his philosophy, the question of being. The hypothesis to be defended will be the following: Heidegger uses the notion of "god" to describe the process of founding a space of meaning. First, I will analyze some counter arguments to this hypothesis, according to which Heidegger would be talking about the possibility that art reconnects us with the gods as such. Then, I will move on to the main argument in which I will link the essay on art fundamentally with the seminary on Parmenides to show how the notion of God is linked to the concept of being and meaning. A widespread need to explain the behavior and outcomes of AI-based systems has emerged, due to their ubiquitous presence. Thus, providing renewed momentum to the relatively new research area of eXplainable AI (XAI). Nowadays, the importance of XAI lies in the fact that the increasing control transference to this kind of system for decision making -or, at least, its use for assisting executive stakeholders- already affects many sensitive realms (as in Politics, Social Sciences, or Law). The decision-making power handover to (...) opaque AI systems makes mandatory explaining those, primarily in application scenarios where the stakeholders are unaware of both the high technology applied and the basic principles governing the technological solutions. The issue should not be reduced to a merely technical problem; the explainer would be compelled to transmit richer knowledge about the system (including its role within the informational ecosystem where he/she works). To achieve such an aim, the explainer could exploit, if necessary, practices from other scientific and humanistic areas. The first aim of the paper is to emphasize and justify the need for a multidisciplinary approach that is beneficiated from part of the scientific and philosophical corpus on Explaining, underscoring the particular nuances of the issue within the field of Data Science. The second objective is to develop some arguments justifying the authors’ bet by a more relevant role of ideas inspired by, on the one hand, formal techniques from Knowledge Representation and Reasoning, and on the other hand, the modeling of human reasoning when facing the explanation. This way, explaining modeling practices would seek a sound balance between the pure technical justification and the explainer-explainee agreement. (shrink)

This chapter presents an analysis of Wang Bi’s (226-249 CE) hermeneutics and reception theory via the concept of “forgetting” (wang 忘) in his essay “Clarifying the Images” (Ming xiang 明象).

Mercedes Valmisa turns our attention to the relations between truth and practice in classical Chinese philosophy. In this tradition, truth is conceived of, in a pragmatic-like spirit, as a series of embodied beliefs and perspectives that lead to fitting dispositions, emotions, and actions (regardless of whether they accurately describe the world, or whether there are other competing beliefs and perspectives that equally accurately or inaccurately describe the world). This means that we should care about truth because of its normative (...) power to guide our behavior in the most fitting way, not because of a theoretical interest in accurately describing reality. Valmisa Oviedo traces the development of this conception of truth in the Mohists and Zhuangists, leading to two radically different sociopolitical and ethical positions: the Mohists used single-truth discourses to enforce ideological monopolies that could not allow pluralism in values, norms, beliefs, and practices, while the Zhuangists warned us against the dangers of such dogmatism. In my dissertation, I explore how emotions operate under conditions of injustice. Specifically, my interest is in how one should deploy their emotions in order to combat patriarchally informed, affective ways of making sense of and responding to the social world. My dissertation consists of the following three papers. In the first paper, “Vindictive Anger,” I argue for two claims. First, that anger is not necessarily made morally worse whenever and to the extent that it involves a desire for payback. (...) Second, that in certain cases, anger’s retributive component is precisely what moralizes the emotion. Victims of sexual violence, I argue, paradigmatically deploy their anger as a way of getting their transgressor or, in some cases, the broader moral community, to more fully understand, through affect, the wrongness of their action. One can see this occur in the anger expressed by Chanel Miller in her victim’s impact statement, read aloud during the case of People v. Turner. When anger functions in this way, I propose, it serves to moralize the emotion. In the second paper, titled “Feminism and Suspect Femininity,” I ask how feminists should feel towards women who conform to suspect norms of appearance, and of hyper-femininity in particular. I present a novel type of empathy – proleptic empathy – which avoids treating women as either pitiful victims or as accomplices deserving of harsh moral criticism. Proleptic empathy requires switching back and forth between two types of imaginings: on the one hand, simulating what it is like to be in the woman’s shoes on the assumption that her suspect behavior stems from her will. On the other, simulating what it is like to be in the woman’s shoes on the assumption that her suspect behavior stems from external cultural influences. In the third paper, “Transitional Moral Contexts,” I address how one should feel towards the perpetrators who figure in the cases that have gone by the language of ‘grey rape’ or ‘bad sex’. These cases are ones that are rife with disagreement, especially amongst members of the moral community, who even disagree over whether they ought to count as cases of ‘sexual assault’ or ‘rape’. My suggestion is that the reason we have such difficulty adjudicating individuals’ responsibility for cases of bad sex is because these are instances of transitional moral contexts where what it is to act morally is in the process of being actively negotiated by the moral community. With this analysis in place, I present reasons for and against deploying shame against those who falter in these cases. (shrink)

Jóvenes con una gran formación y que tienen que abandonar el país por no encontrar empleo adecuado en españa; jóvenes que abandonaron el sistema educativo para incorporarse al mercado (...) laboral y que con la crisis se han quedado sin empleo; jóvenes que no pueden emanciparse por carecer de medios y que como consecuencia de ello, alargan la permanencia en casa de sus padres. Jóvenes que en definitiva ven un futuro incierto en sus vidas. el objetivo de esta introducción es ofrecer una breve panorámica y una presentación de los diferentes artículos incluidos en el presente número de la revista.Youth has become since the beginning of the crisis in 2008, a media subject and also an object of study and research as well as an object of design of public policies with the aim of alleviating the difficult and precarious situation in which many young people are today. Young highly educated who have to leave the country because they don’t find suitable employment in Spain; young people who left the education system to enter the labor market and lost their jobs with this crisis; young people who can not emancipate for lack of means and as a result, extend the stay at their parental home. Young ultimately see an uncertain future in their lives. The purpose of this introduction is to provide a brief overview and presentation of the different articles in this issue of the magazine. Business Ethics: A European Review, EarlyView.

En 1935 Martin Heidegger da sorpresivamente una conferencia en Friburgo sobre el origen de la obra de arte. ¿Por qué Heidegger, repentinamente, brinda una conferencia sobre el arte? ¿Por qué aparece en este año “el arte” como una cuestión decisiva? Solamente encontramos breves menciones sobre esta temática en sus trabajos previos al ensayo sobre el arte. ¿Cómo encuadrar este aparente “oasis” en el pensamiento heideggeriano? A partir del académico estadounidense William Richardson la obra de Martin Heidegger se suele dividir en (...) dos grandes momentos separados por lo que es conocido por el viraje. ¿Desde dónde deberíamos abordar la obra? ¿deberíamos entender sus planteos desde lo trabajado en Aportes a la filosofía? ¿o deberíamos ingresar a “El origen de la obra de arte” desde las obras del primer Heidegger? Estos interrogantes, de carácter metodológico-interpretativo, son los que nos proponemos contestar a lo largo del trabajo, buscando defender la siguiente hipótesis: “El origen de la obra de arte” es una obra “de frontera” entre estos dos momentos del pensamiento de Heidegger, razón por la cual requiere de un abordaje de “ida y vuelta” entre el primer y el segundo Heidegger. This paper presents an empirical study that analyzes everyday practices regarding the health care and education of middle class families grounded in a phenomenological perspective. Everyday practices are linked to the system of expectations and goals built around practices, constituting a configurations of meaning that involves both aspects of the Life-World, which is affected by social class and other social determinants that define areas of experiences and opportunities for social interaction. In this sense, we see that social class and gender (...) intersect each other, enabling and limiting horizons of expectations for children, raising specific jurisdictions to males and females. Finally, we reflect on how the constitution of meanings and everyday practices influences the construction of social relations of the educational and health environments. (shrink)

Aunque durante años hemos asistido a un persistente interés sociológico por la dimensión subjetiva de las prácticas de clase, hasta la fecha pocos son los estudios que han abordado esta problemática desde la perspectiva fenomenológica. Tomando como punto de partida autores que nos antecedieron en esta tarea, el objetivo del presente trabajo es reflexionar sobre los fundamentos de la teoría fenomenológica de Schutz sobre la acción social y su conceptualización de las tipificaciones para el análisis del sentido común y las (...) prácticas de clase. En la primera sección proponemos una breve discusión conceptual en torno a la definición del mundo de la vida proveniente de la teoría de Schutz y su utilidad para el análisis de la estructura social en la línea teórico-metodológica que analiza la reproducción intra-clase y las relaciones entre clases. A continuación resumimos las ideas y conceptos de Weber sobre las clases sociales, acción social y tipo ideal, para luego establecer sus nexos y relaciones con Schutz. Por último, e incorporando la resignificación y complejización que Schutz da a los términos weberianos, proponemos el uso de herramientas fenomenológicas para el análisis de clase. (shrink)

Are emotions bodily feelings or evaluative cognitions? What is happiness, pain, or “being moved”? Are there basic emotions? In this chapter, I review extant empirical work concerning these and related questions in the philosophy of emotion. This will include both (1) studies investigating people’s emotional experiences and (2) studies investigating people’s use of emotion concepts in hypothetical cases. Overall, this review will show the potential of using empirical research methods to inform philosophical questions regarding emotion.

En el presente trabajo se esclarece la noción de “información” según Gilbert Simondon, para lo cual se presenta el contexto histórico-epistemológico desde el cual surge y qué soluciones ofrece a la problemática de la época. Se hace especial énfasis en las conceptualizaciones realizadas por la teoría matemática de la información, la cibernética, y la biología. Luego, se analiza el devenir conceptual de la noción de “información” en el pensamiento de Simondon siguiendo tres momentos de su trabajo académico (clasificados por Juan (...) Manuel Heredia): a) 1944-1958, b) 1959-1968; y c) 1968-1983. Con ello, genero una idea más completa sobre su sentido. (shrink)

The metaphysics of gender and race is a growing area of concern in contemporary analytic metaphysics, with many different views about the nature of gender and race being submitted and discussed. But what are these debates about? What questions are these accounts trying to answer? And is there real disagreement between advocates of differ- ent views about race or gender? If so, what are they really disagreeing about? In this paper I want to develop a view about what the debates (...) in the metaphysics of gender and race are about, namely, a version of metaphysical deflationism, according to which these debates are about how we actually use or should use the terms ‘gender’ and ‘race’ (and other related terms), where moral and political considerations play a central role. I will also argue that my version of the view can overcome some recent and powerful objections to metaphysical deflationism of- fered by Elizabeth Barnes (2014, 2017). (shrink)

In this article, the author compares two Spanish translations of Virginia Woolf’s A Room of One’s Own. Taking into account that Spanish is a language in which words referring to human beings have a feminine and a masculine form, and grammatical gender corresponds to sex, all translators must interrogate the sex of the referent in order to translate gendered words. They are thus compelled to assign sex to genderless forms in the source text. Patriarchal translation has a long tradition of (...) devaluing and excluding the feminine in this process, as the author demonstrates here by revealing how Jorge Luis Borges translated the pronouns you and we in Woolf’s essay. In contrast, in her feminist translation of the essay, María Milagros Rivera-Garretas not only chooses the gender which most accurately represents the likely intended meaning of the source text, but recovers its message and legacy. Analizamos dos momentos constitucionales en la obra de Juan Bautista Alberdi a partir de sus lecturas de Théodore Jouffroy y Benjamin Constant. En el primer caso, ponemos en relieve la concepción filosófico- moral del derecho así como el modelo de publicista que fue Jouffroy para el “joven” Alberdi de 1837. En el segundo, analizamos el modo en que, en 1852, adoptó la postura de Constant para pensar la autoridad política a partir de las diversas teorizaciones del “poder neutral” plasmado en (...) la figura presidencial de la Constitución Nacional de la República Argentina sancionada en 1853. This study aimed to determine the predictive character of organizational socialization and occupational positive mental health on organizational commitment in higher education teachers. A sample of 279 teachers from higher education institutions who signed an informed consent form was used. Fifty-four point five percent of the participants were women, with a mean age of 44.05 years. The participants completed the Organizational Socialization Inventory, the Positive Occupational Mental Health Questionnaire and the Organizational Commitment Scale, and for data analysis descriptive statistics, correlation (...) analysis and multiple linear regression with stepwise method were applied, entering each dimension of organizational commitment separately as a dependent variable. As a result, moderate to weak correlations were identified between the study variables, and it was found that the final models indicate that the future perspectives and socio-affective dimensions predict affective commitment by 38%; that future perspectives, spirituality and age predict normative commitment by 22.8%; and that the future perspectives dimension predicts commitment of continuity by 9.2%. It is concluded that teachers’ expectations about their development in the institution, as well as their interactions at the socio-affective and spiritual level with the work context, are factors that partially influence their attachment to the educational organization. This article will contrast two portrayals of Protagoras: one in the "Theaetetus," where Socrates discusses Protagorean theory and even comes to his defense by imitating the deceased sophist; and another in the "Protagoras," where Socrates recounts his encounter with the sophist. I suggest that Plato wants listeners and readers of the dialogues to hear the dissonance between the two portraits and to wonder why Socrates so distorts Protagoras in the "Theaetetus." Protagoras in the "Protagoras" behaves and speaks in ways that (...) are incompatible with the Protagorean position presented in the "Theaetetus." . (shrink)

Resumen En la década del noventa del último siglo apareció en Alemania el así denominado “giro icónico” (ikonische Wende). Keith Moxey (2009) interpretará este viraje como un nuevo paradigma que, harto del giro lingüístico y la tesis del acceso mediado a la realidad, propone a la imagen como una instancia de acceso inmediato al mundo, eliminando la distinción entre sujeto y objeto. Sin embargo, Boehm sostiene que el giro icónico debe entenderse a partir del giro de todos los giros, el (...) giro trascendental kantiano. La hipótesis que defenderé aquí es que el giro icónico debe entenderse como un pensamiento postkantiano. Abstract The 1990s saw the emergence in Germany of the so-called “iconic turn” (ikonische Wende). Keith Moxey (2009) interprets this turn as a new paradigm that, fed up with the linguistic turn and the thesis of mediated access to reality, proposes the image as an instance of immediate access to the world, eliminating the distinction between subject and object. However, Boehm argues that the iconic turn must be understood on the basis of the turn of all turns, the Kantian transcendental turn. The hypothesis I will defend here is that the iconic turn is to be understood as a post-Kantian thought. (shrink)

This paper challenges the view that contentment leads to personal freedom and autonomy and argues for a relational and exercise concept of de facto freedom in the Zhuangzi 莊子. I first review influential interpretations of freedom in the Zhuangzi that equate freedom with contentment and nonfrustration, starting with Guo Xiang's 郭象 (d. 312 CE). By putting these interpretations in dialog with contemporary social philosophy (Christman, Meyers, Pettit, Elster, and Khader), I reflect on the two seminal problems of the psychologizing causal (...) and procedural approaches that allow the interpretation of freedom as contentment: the “happy slave” problem and the “sour grapes” problem. Proving this account of freedom inadequate, I argue for a different interpretation of freedom in the Zhuangzi that resembles a weakly substantive and constitutive account of freedom and autonomy in modern‐day social philosophy terms, such as Marina Oshana's. The theory of freedom that I analyze in the Zhuangzi, however, helps us correct the risk of material determinism of the constitutive account, offering a description of relational freedom and autonomy as constituted by socio‐material conditions but not determined by them. Philosophy of action in the context of Classical China is radically different from its counterpart in the contemporary Western philosophical narrative. Classical Chinese philosophers began from the assumption that relations are primary to the constitution of the person, hence acting in the early Chinese context necessarily is interacting and co-acting along with others –human and nonhuman actors. This book is the first monograph dedicated to the exploration and rigorous reconstruction of an extraordinary strategy for efficacious relational action devised by Classical (...) Chinese philosophers in order to account for the interdependent and embedded character of human agency –what the author has denominated “adapting” or “adaptive agency” (yin 因). As opposed to more unilateral approaches to action also conceptualized in the Classical Chinese corpus, such as forceful and prescriptive agency, adapting requires great capacity of self and other-awareness, equanimity, flexibility, creativity, and response, which allows the agent to co-raise courses of action ad-hoc: unique and temporary solutions to specific, non-permanent, and non-generalizable life problems. Adapting is one of the world’s oldest philosophies of action, and yet it is shockingly new for contemporary audiences, who will find in it an unlikely source of inspiration to deal with our current global problems. This book explores the core conception of adapting both on autochthonous terms and by cross-cultural comparison, drawing on the European and Analytic philosophical traditions as well as on scholarship from other disciplines, opening a brand-new topic in Chinese and comparative philosophy. A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

En este artículo, se analiza la cuestión de si la existencia del derecho depende necesariamente de la moralidad. La cuestión que ha enfrentado a las doctrinas del derecho natural con el positivismo jurídico. Se trata de mostrar que dicho debate esconde, al menos tres cuestiones diferentes, que requieren respuestas diversas: 1) La cuestión semántica de si las normas positivas injustas son derecho, 2) la cuestión metafísica de si la existencia del contenido del derecho está fundada en hechos morales y 3) (...) la cuestión epistémica de si el contenido del derecho debe ser identificado sin recurrir a consideraciones morales. Se concluye que la primera cuestión es una mera disputa verbal. Se dan algunos argumentos para aceptar la tesis metafísica. Y una respuesta afirmativa a la tercera cuestión es puesta en duda analizando la doctrina de la autoridad de Joseph Raz y, también, tratando de mostrar que el hecho de que algo sea concebible no conlleva que sea metafísicamente posible. In this paper, drawing on evidence internal to the Platonic dialogues (supplemented with some ancient testimonia), I answer the question, “How did Plato teach in the Academy?” My reconstruction of Plato’s pedagogy in the Academy is that there was a single person who read the dialogue aloud like a rhapsode (this is in contrast to the dramatic theatrical hypothesis, in which several speakers function as actors in the performance of a dialogue). After the rhapsodic reading, students were allowed to ask (...) that portions of the text to be re-read, to ask a question about the text, and were encouraged to enter into a broader conversation about the topic and themes brought out by the text. This later pedagogical method of interrogating and investigating a dialogue is of more importance than the mere reading of a dialogue. I contend that Plato’s experiences teaching were woven into some of the dialogues, and that Plato’s pedagogy reflects some of the ways that he taught in the Academy. I propose that excellent points made by students may have been written into revised forms of the dialogue. And not only good points, but also mistakes in reasoning may have been added into the dialogues. I suggest that the way certain dialogues are organized with “guest lecturers” and “tag-team” philosophical debates reflect Plato’s pedagogy in the Academy. Plato’s broadmindedness, his openness to various and opposing viewpoints, is also evident from both outside and inside of the dialogue. Lastly, drawing on the idea of Socratic mimēsis, I give a plausible curriculum for how Plato may have used the dialogues to teach them: he had his students “play” with them. Plato may have asked his students to enter into the roles of the characters in the dialogues to better understand them and the type of person they represent. Plato may have also asked students to take over from the position of the character in the dialogue and to suggest a better, truer account of things than what the characters said or did. (shrink)
